A quick note before we begin.

These Terms and Conditions govern your use of our website and any purchase you make with Pehnari. We have written them as clearly as we can. If something is unclear, please write to us at pehnari@gmail.com before placing an order — we would rather answer a question than have a misunderstanding.

By using our website or placing an order, you agree to these Terms.

OVERVIEW

Pehnari operates this website and online store, including all related information, content, features, tools, products and services (the "Services"). Pehnari is powered by Shopify, which enables us to provide the Services to you.

These Terms of Service, together with any policies referenced herein, describe your rights and responsibilities when you use the Services.

Please read these Terms carefully, as they include important information about your legal rights, including warranty disclaimers and limitations of liability.

By visiting, interacting with, or using our Services, you agree to be bound by these Terms of Service and our Privacy Policy. If you do not agree to these Terms or our Privacy Policy, you should not use or access our Services.

SECTION 1 — WHO WE ARE

Pehnari is a women's Indo-Western apparel brand founded by Sargam Arora, operating in India. We create clothing featuring Indian handcrafted art, designed for the modern Indian woman's everyday wardrobe.

All products sold through our website and social media channels are designed, curated, and fulfilled by Pehnari.

SECTION 2 — ACCESS AND ACCOUNT

By agreeing to these Terms, you represent that you are at least 18 years of age and have the legal authority to enter into a binding agreement.

To use our Services, including browsing or purchasing, you may be asked to provide information such as your name, email address, contact number, and shipping and payment details. You represent and warrant that all information you provide is correct, current, and complete.

You are solely responsible for maintaining the security of your account credentials and for all activity under your account. You may not transfer, sell, assign, or license your account to any other person.

SECTION 3 — OUR PRODUCTS

Handcrafted nature of our products
All Pehnari garments are handcrafted by skilled artisans using traditional Indian embroidery and craft techniques. Because every piece is made by hand, there may be minor variations in embroidery placement, thread density, or finish between pieces. These variations are not defects — they are the natural result of human craftsmanship and part of what makes each Pehnari piece unique.

Colours and appearance
We make every effort to display our products accurately on our website. However, colours may appear slightly different depending on your device's screen settings and calibration. We are not responsible for colour variations caused by display differences.

Product availability
All products are subject to availability. We reserve the right to limit quantities or discontinue any product at any time without prior notice.

SECTION 4 — ORDERS

When you place an order with Pehnari, you are making an offer to purchase. Your order is confirmed only when you receive a confirmation from us via email or direct message.

We reserve the right to decline or cancel any order at our discretion, including in cases of:

  • Product unavailability or stock issues
  • Suspected fraudulent or unauthorised activity
  • Pricing errors
  • Inability to verify your information

If your order is cancelled after payment has been made, a full refund will be processed within 7–10 business days to your original payment method.

Your purchases are subject to return or exchange solely in accordance with our Returns Policy.

You represent and warrant that your purchases are for your own personal or household use and not for commercial resale or export.

SECTION 5 — PRICING

All prices displayed on our website are in Indian Rupees (INR) and are inclusive of applicable taxes unless stated otherwise.

We reserve the right to change prices at any time without prior notice. Price changes will not affect orders that have already been confirmed.

If a pricing error occurs on our website, we reserve the right to cancel the affected order and issue a full refund. We will notify you promptly if this happens.

SECTION 6 — PAYMENT

We currently accept payments through:

  • Razorpay (cards, UPI, net banking, wallets)
  • UPI transfers (GPay, PhonePe, Paytm) where applicable
  • Cash on Delivery (COD) — subject to an advance confirmation charge of ₹250, collected via WhatsApp before dispatch

All payments must be made in full before your order is processed and dispatched.

Pehnari does not store your card details, CVV, or UPI credentials. All payment information is handled directly and securely by our payment partners.

If a payment fails or is declined, please contact your bank or payment provider. Pehnari is not responsible for failed transactions caused by your bank or payment gateway.

SECTION 7 — SHIPPING AND DELIVERY

We currently deliver within India only. For international orders, please reach out to us on WhatsApp at +91 7973701577.

Processing time
Orders are dispatched within 3 business days of payment confirmation. During high-demand periods or collection launches, processing time may be slightly longer. We will keep you informed.

Delivery time
Estimated delivery in 5–7 business days depending on your location and courier partner. All delivery timelines are estimates and are not guaranteed.

Shipping charges
Standard shipping is free on all orders across India. COD orders are subject to an additional advance confirmation charge of ₹250.

Risk and title
Once your order is dispatched and handed to our courier partner, the risk of loss or damage passes to you. We will provide you with a tracking number so you can monitor your shipment.

Failed delivery
If a delivery attempt is unsuccessful due to reasons within your control (incorrect address, unavailability), any re-delivery charges will be borne by you.

We are not liable for shipping and delivery delays caused by courier partners, natural events, or circumstances outside our control.

SECTION 8 — CANCELLATIONS, RETURNS AND EXCHANGES

All cancellations, returns, and exchanges are governed by our Returns Policy, which forms part of these Terms and can be viewed on our website.

In summary:

  • Cancellations are accepted within 24 hours of placing an order
  • Returns are accepted within 5 days of delivery, subject to conditions and a ₹400 handling deduction
  • Exchanges are accepted within 5 days of delivery, subject to conditions
  • Refunds for cancellations and eligible returns are issued as Pehnari gift cards valid for 365 days

SECTION 9 — INTELLECTUAL PROPERTY

All content on our website and Services, including but not limited to trademarks, brand name, text, images, graphics, product photography, video, and audio, and the design, selection, and arrangement thereof, are owned by Pehnari or its licensors and are protected by applicable intellectual property laws.

These Terms permit you to use the Services for your personal, non-commercial use only. You must not reproduce, distribute, modify, create derivative works of, publicly display, republish, download, store, or transmit any material from the Services without our prior written consent.

Pehnari's name, logo, product names, designs, and slogans are trademarks of Pehnari. You must not use such trademarks without our prior written permission.

Shopify's name, logo, product and service names, designs and slogans are trademarks of Shopify. All other names, logos, and slogans on the Services are the trademarks of their respective owners.

SECTION 10 — RELATIONSHIP WITH SHOPIFY

Pehnari is powered by Shopify, which enables us to provide the Services to you. However, any sales and purchases you make on our website are made directly with Pehnari. By using the Services, you acknowledge and agree that Shopify is not responsible for any aspect of any sales between you and Pehnari, including any injury, damage, or loss resulting from purchased products and services. You hereby expressly release Shopify and its affiliates from all claims, damages, and liabilities arising from or related to your purchases and transactions with Pehnari.

SECTION 11 — PRIVACY POLICY

All personal information we collect through the Services is subject to our Privacy Policy, which can be viewed on our website. Certain personal information may also be subject to Shopify's Privacy Policy. By using the Services, you acknowledge that you have read these privacy policies.

Because the Services are hosted by Shopify, Shopify collects and processes personal information about your access to and use of the Services in order to provide and improve the Services for you.

SECTION 12 — THIRD-PARTY LINKS AND TOOLS

Our website may contain links to third-party websites or provide access to third-party tools. We are not responsible for the content, accuracy, or privacy practices of any third-party websites or tools. Your use of third-party websites and tools is entirely at your own risk.

If you submit any ideas, suggestions, feedback, or reviews to Pehnari, you grant us a perpetual, worldwide, royalty-free licence to use, reproduce, modify, publish, and distribute such feedback for any purpose, including to improve and promote our Services.

You represent that you own or have all necessary rights to any feedback you submit, and that your feedback does not violate the rights of any third party.

SECTION 14 — PROHIBITED USES

You may access and use the Services for lawful purposes only. You may not:

  • Use the Services for any unlawful, fraudulent, or malicious purpose
  • Infringe upon our intellectual property rights or those of others
  • Transmit false, misleading, or harmful information
  • Upload viruses or malicious code
  • Reproduce, duplicate, copy, or resell any part of the Services
  • Use automated tools, bots, scrapers, or AI agents to access the Services without our consent

EXCEPT AS EXPRESSLY STATED BY PEHNARI, THE SERVICES AND ALL PRODUCTS OFFERED THROUGH THE SERVICES ARE PROVIDED 'AS IS' AND 'AS AVAILABLE' WITHOUT ANY REPRESENTATION, WARRANTIES OR CONDITIONS OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING ALL IMPLIED WARRANTIES OR CONDITIONS OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, DURABILITY, TITLE, AND NON-INFRINGEMENT.

SECTION 17 — LIMITATION OF LIABILITY

TO THE FULLEST EXTENT PROVIDED BY LAW, IN NO CASE SHALL PEHNARI, OUR PARTNERS, DIRECTORS, OFFICERS, EMPLOYEES, AFFILIATES, AGENTS, CONTRACTORS, SERVICE PROVIDERS OR LICENSORS, OR THOSE OF SHOPIFY AND ITS AFFILIATES, BE LIABLE FOR ANY INJURY, LOSS, CLAIM, OR ANY DIRECT, INDIRECT, INCIDENTAL, PUNITIVE, SPECIAL, OR CONSEQUENTIAL DAMAGES OF ANY KIND, INCLUDING WITHOUT LIMITATION LOST PROFITS, LOST REVENUE, LOST SAVINGS, LOSS OF DATA, REPLACEMENT COSTS, OR ANY SIMILAR DAMAGES, WHETHER BASED IN CONTRACT, TORT, STRICT LIABILITY OR OTHERWISE, ARISING FROM YOUR USE OF ANY OF THE SERVICES OR ANY PRODUCTS PROCURED USING THE SERVICES.

SECTION 18 — INDEMNIFICATION

You agree to indemnify, defend, and hold harmless Pehnari, Shopify, and our affiliates, partners, officers, directors, employees, agents, contractors, licensors, and service providers from any losses, damages, liabilities, or claims, including reasonable legal fees, arising out of your breach of these Terms, your violation of any law or the rights of a third party, or your access to and use of the Services.

SECTION 19 — SEVERABILITY

If any provision of these Terms is determined to be unlawful, void, or unenforceable, that provision shall be enforceable to the fullest extent permitted by applicable law, and the unenforceable portion shall be deemed severed from these Terms. This shall not affect the validity and enforceability of any other remaining provisions.

SECTION 20 — WAIVER AND ENTIRE AGREEMENT

The failure of Pehnari to exercise or enforce any right or provision of these Terms shall not constitute a waiver of such right or provision.

These Terms, together with our Privacy Policy and Returns Policy, constitute the entire agreement between you and Pehnari and govern your use of the Services, superseding any prior agreements between you and us.

SECTION 21 — GOVERNING LAW

These Terms of Service shall be governed by and construed in accordance with the laws of India. Any disputes arising out of or in connection with these Terms shall be subject to the exclusive jurisdiction of the courts in Amritsar, Punjab, India.

SECTION 22 — CHANGES TO TERMS

We reserve the right to update or replace any part of these Terms at any time. Changes will be effective on the date they are posted on our website. Your continued use of our Services after any changes constitutes your acceptance of the updated Terms.
